The Four Levels of a Social Security Disability Appeal

Appeal requests generally must be filed within 60 days after you receive the applicable notice. The Social Security Administration ordinarily presumes that a notice arrived five days after its date unless you can show that you received it later. Because each stage has different forms and standards, the decision you received determines which review to request.

Reconsideration

Reconsideration is another review by a disability examiner and medical team that didn’t participate in the initial decision. You may submit updated medical records and other information that addresses the reasons for the denial.

Administrative Law Judge Hearing

After a reconsideration denial, you may request a hearing before an Administrative Law Judge. You and your attorney can present legal arguments, documentary evidence, and testimony. The judge may question you and hear from medical or vocational experts before issuing a decision.

Appeals Council Review

The Appeals Council reviews challenges to unfavorable hearing decisions. It may deny review, dismiss the request, issue a decision, or return the case to an Administrative Law Judge for further proceedings. This review focuses on whether a legal, factual, or procedural issue warrants additional action.

Federal District Court Review

After the Appeals Council stage, you may be able to file a civil action in federal district court. This isn’t a new disability hearing. The court generally examines the administrative record and the legal basis for the agency’s final decision.

Evidence & Issues That Can Affect an Appeal

An effective appeal responds to the basis for the denial rather than simply repeating the original application. Medical evidence should connect your diagnoses and symptoms to specific physical or mental limitations that affect your ability to work.

Issues that may require attention include:

• Incomplete medical records: Treatment notes, test results, specialist records, or updated evaluations may be missing from the claim file.
• Residual functional capacity: This assessment addresses what you can still do physically and mentally despite your limitations. An appeal may challenge whether it reflects the complete record.
• Daily activity descriptions: Statements about household tasks, personal care, driving, or shopping may need context about the assistance required, how often the activity occurs, and how long recovery takes.
• Work-history questions: Inaccurate or incomplete descriptions of past job duties can affect the agency’s evaluation of whether you can return to prior work.
• Procedural requirements: Missing forms, unanswered requests, or late evidence can complicate the review process.

Evidence Deadlines Before a Hearing

For an Administrative Law Judge hearing, you generally must submit written evidence or inform the Social Security Administration about it no later than five business days before the hearing. Agency rules allow exceptions in some circumstances, but waiting until the final days may leave too little time to obtain and organize important records.

Late Appeals & Good Cause

Missing an appeal deadline doesn’t necessarily end your claim. You may ask the Social Security Administration to extend the filing period by showing good cause for the delay. Serious illness, difficulty understanding the notice, or receiving it late may be relevant, but the agency decides whether the circumstances satisfy the rules for that stage.
